TERMS OF SERVICE FOR OWNERS AND AUTHORIZED USERS
ENLITE RESEARCH PRIVATE LIMITED (“ENLITE”, “Us” or “Our”)
These Terms of Service (“Terms”) govern your use of the Know Your Building™ application, the integrated devices, and the services provided by ENLITE RESEARCH PRIVATE LIMITED. By accessing or using the Services, you agree to these legally binding terms. If you do not agree, refrain from using the Services.
1. Definitions
- Account: The user account created during the registration process.
- Personal Information: Personally identifiable information such as name, email, phone number, and location.
- Services: The Know Your Building™ application, integrated devices, and all related features, tools, and content provided by ENLITE.
- Know Your Building™ Application (KYB): The web application accompanying the integrated devices for managing buildings and assets.
- Third Party: Any person or entity other than the User and ENLITE.
- User: Individuals with access to the Services, including Owners, Authorized Users, and Guests.
- Website: www.enliteresearch.com and connected pages.
2. Nature & Scope of Terms and Account Access
- These Terms govern the access and usage of the Know Your Building™ application and integrated devices.
- Users are categorized as:
- Owner: The individual who owns the Know Your Building™ application and integrated devices.
- Authorized User: Individuals authorized by the Owner to control the application and devices.
- Guest: Individuals granted temporary access by an Owner or Authorized User.
3. Intended Use
The Know Your Building™ application and integrated devices are intended for commercial and industrial premises only. They are not designed for home security, and ENLITE assumes no liability for unintended use.
4. Registration
To use the Services, you must register for an Account by providing accurate and complete information. You can delete your Account, but some Services may become unavailable.
5. Limited Privilege to Access & Use
ENLITE grants Users a non-exclusive, revocable, non-transferable, royalty-free right to access and use the Services, subject to compliance with these Terms.
6. Preliminary Terms & Conditions
By accepting these Terms, you agree to:
- Use the Services only for permitted purposes.
- Maintain the confidentiality of your Account credentials.
- Provide accurate and complete information.
- Ensure proper internet connectivity and hardware for optimal functionality.
7. Communication Policy
- Provide accurate information during registration.
- Consent to receive OTPs and notifications via SMS or email.
- Acknowledge that ENLITE is not responsible for delays or failures in notifications.
8. License Restrictions & Acceptable Usage
- Use the Services lawfully and in compliance with these Terms.
- Do not reverse engineer, modify, or distribute the Services without ENLITE’s permission.
9. Third-Party Services
The Services may integrate with third-party products and services. ENLITE is not responsible for the content, functionality, or security of third-party services.
10. Confidentiality
Users must keep all confidential information received from ENLITE secure and not disclose it to third parties.
11. Publicity
Users may not issue press releases or use ENLITE’s trademarks without prior written consent.
12. Safety & Security
ENLITE ensures the safety and security of its devices in compliance with industry standards.
13. User’s Personal Information
Personal Information collected through the Services is handled in accordance with ENLITE’s Privacy Policy.
14. Representations
Users represent that they are legally able to enter into contracts and will comply with all applicable laws.
15. Copyright, Trademark & Design
ENLITE retains all intellectual property rights in the Services. Users may not reproduce, distribute, or modify any content without permission.
16. Eligibility for Usage
Users must be at least 18 years old to register for an Account.
17. Services & Website
Users must not violate the security of the Services or Website, including unauthorized access or interference with service.
18. Rights Reserved by ENLITE
ENLITE reserves the right to limit purchases, refuse orders, and update the Services without prior notice.
19. Limitations
ENLITE does not guarantee uninterrupted or error-free Services and is not responsible for third-party failures.
20. Limitation of Liability
ENLITE is not liable for any indirect, incidental, or consequential damages arising from the use of the Services.
21. Indemnity
Users agree to indemnify ENLITE against any claims arising from their use of the Services.
22. Warranties & Disclaimers
The Services are provided “AS IS,” and ENLITE disclaims all warranties, except as expressly stated in these Terms.
23. Reviews
Users are solely responsible for the content they submit and must not violate third-party rights.
24. Force Majeure
ENLITE is not liable for delays or non-performance caused by events beyond its control.
25. Termination
ENLITE may terminate this Agreement at any time without notice or liability.
26. Relationship
The Parties are independent contractors, and nothing in these Terms creates a partnership or employment relationship.
27. Notices
Notices to ENLITE must be sent via email to connect@enliteresearch.com.
28. Severability
If any provision is found unenforceable, it shall be modified to the fullest extent permitted by law.
29. Governing Law & Jurisdiction
These Terms are governed by Indian law, and disputes shall be resolved in the courts of Goa.
30. Changes to Products, Modification of Terms
ENLITE reserves the right to modify the Services or these Terms at any time. Continued use constitutes acceptance of the changes.
